Terms of Use

Article 1 (Purpose)
① The purpose of the Terms of Use is to define the rights, obligations, responsibilities, and other necessary matters between the International Association of Korean Lawyers (“IAKL”) and the Member regarding the use of website services (“Service”) provided by IAKL.
② IAKL considers the act of checking the consent box before making the membership registration as an agreement to these Terms of Use.

Article 2 (Definitions)
The definitions of the terminology used in the Terms of Use are as follows:
1. “Member” refers to a person who accesses the IAKL website, signs an Agreement for Use with IAKL in accordance with these Terms of Use, and uses the Service.
2. “User” refers to members and non-members who use the Service.
3. “ID” refers to a combination of letters and numbers set by the Member and authorized by IAKL for the purpose of identifying the Member and using the Service.
4. “Password” refers to a combination of letters or numbers set by the Member in order to protect his/her confidentiality and to identify whether the Member matches with the given ID.

Article 3 (Amendment)
① IAKL may amend the Terms of Use as necessary, such as the addition of a new service or when there are other important reasons based on IAKL’s policy.
② IAKL shall send or post a notice thirty (30) days prior to the application of the amendment, and if the Member does not raise an objection explicitly, the Member shall be deemed to have agreed to the amended version of the Terms of Use.
③ When the Member does not agree to the amended Terms of Use, the Member may terminate the agreement for use (withdraw membership).

Article 4 (Entering into the Agreement for Use)
① The Agreement for Use shall be entered into after the person who wishes to become a Member (“Applicant”) agrees to the Terms of Use and applies for membership, and IAKL approves the application.
② In principle, IAKL shall grant the Applicant the right to use the Service. However, IAKL may disallow the Applicant from using the Service, or may terminate the Agreement for Use at a later date in the following cases where:
1. The Applicant used another person’s name or a name other than his/her real name;
2. The Applicant entered false information;
3. The Applicant had a purpose to violate the relevant laws or offend public order and good morals; or
4. The Applicant does not otherwise meet the minimum requirements of IAKL membership qualification.
③ The Agreement for Use shall be entered into at the time when IAKL displays that the membership registration has been completed in the application process.
④ IAKL may categorize Members into different levels pursuant to IAKL’s policy and give differential treatment to the Members using the Service.

Article 5 (Providing Service)
① In principle, the Service is provided all year around, 24 hours a day. However, IAKL may temporarily stop providing the Service at a specified date and time, if there is a maintenance check, repair, replacement, breakdown of facilities and when there are other significant operational issues. In such a case, IAKL shall give a prior notification to the Members.
② IAKL shall not have the duty to give prior notification when the Service is interrupted due to reasons beyond IAKL’s control or due to a third party’s intentional or negligent act.

Article 6 (Obligation of IAKL)
① IAKL has a duty to provide the Service in a stable and consistent manner as provided by these Terms of Use.
② IAKL shall make efforts to protect the Member’s personal information in accordance with the relevant laws, including the Personal Information Protection Act. However, IAKL’s Privacy Policy shall not be applied to linked websites, other than IAKL’s official website.
③ IAKL shall not disclose or disseminate the Member’s personal information to a third party without the Member’s consent, except when it may be requested by governmental organizations based on the relevant laws.

Article 7 (Obligation of Members)
① The Member shall be responsible for managing his/her ID and password, and shall not let a third-party access the website without IAKL’s approval.
② The Member shall notify IAKL immediately when he/she recognizes that his/her ID has been used unlawfully. IAKL shall not be responsible for any damages that might occur as a result of the Member not notifying IAKL of the fact, or the Member not following IAKL’s guide even if he/she notified IAKL.

Article 8 (Restriction on Using the Service)
IAKL may restrict or terminate the Member’s use of the Service if any of the following cases apply:
1. The Member registered false information when applying for membership or modifying information;
2. The Member used another person’s ID and Password;
3. The Member obtained another Member’s email address and sent unsolicited communications (spam emails);
4. The Member created more than one personal account;
5. The Member used the Service to commit acts related to crimes;
6. The Member used the Service to offend the public order and good morals;
7. The Member damaged another person’s reputation or caused damage to that person;
8. The Member interfered or disrupted the Service of its normal and ordinary use; or
9. The Member committed other acts contrary to the relevant laws or IAKL’s policy.

Article 9 (Postings)
IAKL may delete the posting of a Member without prior notice, if:
1. The posting infringes upon the rights or damages the reputation of another Member or a third party;
2. The posting offends the public order and socially accepted norms;
3. The posting is recognized to be related to criminal acts;
4. The posting is contrary to IAKL’s policy or its interest, or has caused damages to IAKL; or
5. The posting contains unauthorized commercial communications.

Article 10 (Providing Information)
IAKL, through public notices or emails, may provide various types of information recognized as necessary for the Member in using the Service. However, the Member may refuse to receive the information at any time.

Article 11 (Ownership of Rights)
① IAKL shall own copyrights and intellectual property rights of the Service and its postings.
② The copyright of a posting posted by the Member on the website shall vest in the author of the posting.
③ The User shall not use the Service commercially, such as by processing or selling the information published on the website.

Article 12 (Compensation for Damages)
IAKL shall not be held liable for any damages incurred to the Member in relation to the provision of its free Service, except when IAKL caused the damage intentionally, by gross negligence, or when a special provision is specified in the relevant laws.

Article 13 (Limitation of Liability)
① IAKL shall be exempt from any responsibility related to providing the Service in cases where:
1. IAKL is unable to provide the Service due to natural disasters or force majeure;
2. The cause of the error is attributable to the Member; or
3. The cause is otherwise not due to IAKL’s intentional act or negligence.
② IAKL shall not be responsible for the credibility and accuracy of the information, documents and facts that the Members post on the Service.

Article 14 (Governing Law and Jurisdiction)
Any disputes arising between IAKL and the Member regarding the use of the Service shall be governed by the laws of Republic of Korea, and any lawsuits shall be brought exclusively before the court having jurisdiction over the area where IAKL’s office is located.

- These Terms of Use shall come into effect on 24 April, 2014.
- In case of any discrepancies between the Korean and English version of the Terms of Use, the Korean version shall prevail.
